If you have a common lease with no end date, any tenant can give a legal “notice of termination.” This ends the tenancy agreement for all tenants who are roommates. If you have a separate lease, it probably means that you are living with strangers. Respect each other`s privacy and lifestyle and ensure that common areas are kept clean and not abused. Make sure you know who is called on the bills so that everything is properly paid and remember to respect your rental agreement, even if other tenants break them. If someone you share with wants to leave, they have to increase it with the owner. Whether they leave or not has no influence on your lease. Part 2 of my series, which deals with different types of leases. If you live in a common house but rent to a tenant who lives in the property, you are probably an excluded occupant. Flatmates.com.au recommends the application of the right to rent housing, as it creates security and clarity on all rights and obligations in housing. For example, the right to lease defines how obligations, access to the lessor and termination are due. If you share a home but have your own individual lease, there are generally fewer things you need to worry about than if you had a lease in common with the other people you live with.
Assured Shorthold Tenancies (AST) is the most common form of rental in the UK if the owner does not live in the property – this is the standard agreement if you do not specify another type if you rent your property. An Assured Shorthold lease allows the lessor or tenant to terminate the lease after an initial six-month period by announcing termination. If you wanted to take over the unit, if the only tenant is gone, you can negotiate with the chief renter and establish a new contract. In certain circumstances, you can also argue that a new lease has been created if the landlord accepts the rent from you, knowing that the tenant has left alone. A common law agreement is more flexible than a rental contract, because roommates can accept all the conditions. However, since all terms must be negotiated and agreed, common law agreements are often not as comprehensive or defined as a lease agreement.
